Terms of Service

1. Acceptance of Terms

This End User License Agreement ("EULA" or "Terms") is a legal agreement between you and Dank Siege ("we," "us," "our") governing your use of the Dank Siege mobile game and related services (the "Service"). By downloading, installing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. License to Use

We grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use Dank Siege for personal, non-commercial entertainment purposes only.

You may not:

• Modify, reverse-engineer, decompile, or disassemble the Service
• Use bots, automation, scripts, or cheat software
• Exploit bugs, vulnerabilities, or unintended game behavior
• Share your account credentials or transfer your account
• Attempt to interfere with the Service or other users
• Use the Service for any unlawful or fraudulent purpose
• Use the Service in jurisdictions where it is prohibited

3. Wallet Connection & Crypto Features

Dank Siege uses the Solana blockchain and the Mobile Wallet Adapter (MWA) for account identification, in-game purchases, and Genesis-holder verification. By connecting a wallet, you acknowledge:

• You are solely responsible for the security of your wallet, seed phrase, and private keys
• We never request your seed phrase or private key
• You are responsible for verifying every transaction before signing
• Solana network transactions are irreversible and recorded permanently on a public blockchain
• We do not custody, control, or have access to your wallet or its contents

4. In-Game Purchases

• The Service offers in-game purchases (loot chests, Dank Pass, bundles) payable in $SOL or $SKR
• All in-game purchases are non-refundable. Once a transaction is signed and confirmed on-chain, it cannot be reversed by us
• In-game items, currencies ($DANKS, $COPIUM, $HOPIUM, $LEAN), and progress are provided for entertainment purposes only and have no real-world monetary value
• Prices, drop rates, and rewards may change without notice during the pre-season beta
• We are not responsible for failed transactions, network congestion, gas fees, or duplicate transactions
• If you experience a payment issue caused by a verified bug on our side, contact support — we may at our discretion grant in-game compensation, but we are under no obligation to do so

5. User Responsibilities

• Keep your wallet, seed phrase, and private keys secure
• Verify all transactions before confirming in your wallet
• Comply with all applicable laws and regulations in your jurisdiction
• Report bugs, security issues, or abuse to support.danksiege@gmail.com
• Maintain accurate contact information for support correspondence

6. No Warranty

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied. We disclaim all warranties, including merchantability, fitness for a particular purpose, non-infringement, and uninterrupted operation. We do not warrant that the Service will be error-free, secure, or available at all times.

7. Limitation of Liability

To the fullest extent permitted by law, Dank Siege and its creators, contributors, and affiliates are not liable for:

• Loss of cryptocurrency, tokens, NFTs, or in-game items
• Wallet security breaches or compromised accounts
• Failed, dropped, or malformed blockchain transactions
• Gameplay bugs, glitches, exploits, or unintended behavior
• Server downtime, service interruption, or data loss
• Third-party wallet, RPC provider, or infrastructure failures
• Indirect, incidental, special, consequential, or punitive damages

To the extent any liability cannot be excluded, our total aggregate liability is limited to the amount you paid for in-game purchases in the 6 months preceding the claim, or USD $50, whichever is greater.

8. Account Termination

We reserve the right to terminate, suspend, or restrict your account at any time, with or without notice, for:

• Using cheats, bots, exploits, or automation
• Harassment, abusive behavior, or community-rule violations
• Suspicious or fraudulent activity
• Violation of these Terms
• Legal or regulatory requirements

Termination may result in loss of progress, in-game items, and Dank Pass benefits without refund.

9. Intellectual Property

All content in Dank Siege — including artwork, characters, gameplay mechanics, code, audio, and assets — is owned by Dank Siege or its licensors. You may not use these materials outside the Service without written permission, except for fair use such as reviews, gameplay videos, screenshots, and personal social media posts.

10. Third-Party Services

Dank Siege relies on third-party services we do not control:

• The Solana blockchain network
• Mobile Wallet Adapter and connected wallets (Phantom, Solflare, Seed Vault, etc.)
• Solana RPC providers
• Supabase (cloud infrastructure)
• The Solana dApp Store (if applicable)

We are not responsible for the availability, security, or behavior of these third-party services.

11. Solana dApp Store Distribution

If you obtained Dank Siege through the Solana dApp Store, you acknowledge that this EULA is a direct agreement between you and Dank Siege. Solana Mobile Inc. is not a party to this EULA and has no obligations or liability with respect to your use of Dank Siege. Your use of the Solana dApp Store is separately governed by the Solana dApp Store Terms of Use.

12. Changes to Terms

We may update these Terms at any time. Material changes will be communicated via the Service or this page. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

13. Age Restrictions

Dank Siege is intended for users 13 years and older. By using the Service, you represent that you are at least 13 years old (or the minimum age in your jurisdiction). Parents or guardians of users under 18 are responsible for monitoring their use of the Service, including any in-game purchases.

14. DMCA & Copyright

If you believe content in Dank Siege infringes your copyright, send a notice to support.danksiege@gmail.com including:

• Your name, address, telephone, and email
• Description of the copyrighted work claimed to be infringed
• Specific location of the allegedly infringing material in the Service
• A statement under penalty of perjury that the complaint is accurate
• Your physical or electronic signature

15. Data Rights

Your data rights and our handling of personal information are described in the Privacy Policy. To request access, correction, deletion, or portability, contact support.danksiege@gmail.com.

16. Dispute Resolution

1. For any dispute, first contact us at support.danksiege@gmail.com in good faith
2. If unresolved within 30 days, the dispute may be brought to binding arbitration or small claims court where permitted by law
3. You agree to resolve disputes individually and waive any right to participate in a class action, where legally permitted

17. Governing Law

These Terms are governed by the laws of the jurisdiction in which Dank Siege operates, without regard to conflict-of-law principles. Where local consumer protection law provides additional rights to you, those rights are preserved.

18. Severability

If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force and effect.

19. Entire Agreement

These Terms, together with the Privacy Policy and Copyright Notice, constitute the entire agreement between you and Dank Siege regarding the Service.
